Subscriber Agreement

Privacy Policy

The person designated on the reverse side as Subscriber and at the address stated (Premises) has requested Cable Television services from Litestream Holdings, LLC (“Company”). Upon acceptance of this service by Subscriber and in consideration thereof the Subscriber agrees to comply with the following conditions of service.

  1. The Company assumes no responsibility for the operation, maintenance, service or repair of the Subscriber’s television set.
  2. Subscriber agrees to pay, when due, the required connection charge, and to pay in advance the annual or monthly service charge as prescribed by the Company.
  3. All equipment installed or provided inside or outside the premises by the Company shall remain the property of the Company. The Subscriber agrees to pay the Company full replacement value of any of the Company’s equipment not returned to the Company upon disconnection, together with any cost incurred by the Company in obtaining or attempting to obtain possession of any such equipment or payment of such amounts.
  4. The Subscriber shall bear the entire risk of loss by theft, fire and destruction or damage from any case whatsoever of the Company’s equipment, including: converters, digital units or modems (herein called loss or damage). No loss or damage shall relieve the Subscribers of the obligation to pay rent or any other obligation under this agreement. In the event of loss or damage, the Subscriber, at the option of the Company, shall pay to the Company, loss or damage of the value of the equipment. It is agreed that the value of the digital unit is up to $500.00 plus applicable taxes, the value of the converter is up to $250.00 plus applicable taxes and the value of the modem is up to $75.00 plus applicable taxes. It is advisable that the Subscriber have the digital unit, converter and/or modem added to their house insurance policy.
  5. The equipment installed inside or outside the premises is intended for installation and use at the service address stated on the face of this order. It shall not be removed from there during the life of this agreement.
  6. Company employees or agents shall be allowed reasonable access to Subscriber’s premises to install, inspect, maintain or disconnect services or equipment and removal of Company equipment.
  7. The Company shall have the right to deduct or offset any charges which Subscriber may owe the company against pre-paid service charges or deposit of any services provided by Company.
  8. Should the Company have to effect a collection or disconnection procedure while service is still connected, a collection fee plus applicable taxes will be charged. A Late Fee will apply on past due accounts.
  9. Any unauthorized attachments to the Company’s cable or equipment, or tampering with the Company’s equipment or unauthorized use of the Company’s signals, constitutes a breach of this Agreement and theft under the State and Federal code.
  10. Any unauthorized connection will be removed by the Company and the detection and removal cost shall be paid by the Subscriber and may result in criminal prosecution and termination of all services. An improper Hook-Up can cause signal or total disruption of service to yourself, your neighbors and other Subscribers; BUT MORE SERIOUS IS THE SIGNAL LEAKAGE, WHICH COULD INTERFERE WITH AIRCRAFT NAVIGATIONAL FREQUENCIES. Obtaining Cable Service without payment is illegal under the State and Federal Law.
  11. An administration fee of $50.00 will be charged, should Subscriber’s check for payment of any services be returned unpaid for any reason by Subscriber’s bank or financial institution.
  12. Subscriber agrees it shall be his obligation to return all Company equipment on or before termination date.
  13. All HSD customers are subject to the terms and limitations of the Litestream Holdings Acceptable Use Policy, including but not limited to terms of bandwidth usage and overuse policy. For more information customers may review the entire AUP at www.litestream.net.
  14. Directory Assistance, Long Distance and International Calling fees are charged when applicable.

TELEPHONE USE AGREEMENT

  1. User shall use the Service for lawful purposes only. User shall not transmit through the Service any material (including any message or series of messages) that violates or infringes in any way upon the rights of others (including copyright), that is unlawful, threatening, abusive, obstructive, harassing, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane or otherwise objectionable, that encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any law.
  2. Advertising, reselling, reuse or any solicitation with respect to products or services is strictly prohibited without express written approval from Telephone Provider and a contract for payment of related fees.
  3. User gives Telephone Provider consent to use, distribute, sell, transfer, loan, or otherwise share with other persons or entities, user lists as well as aggregate information, but not contrary to any applicable laws.
  4. Telephone Provider reserves the right to refuse service to Users due to insufficient or invalid charging information.
  5. Telephone Provider may block calls that are made to certain numbers, cities or central office exchanges, in its sole discretion, deems reasonably necessary to prevent unlawful or fraudulent use of the Service.
  6. Telephone Provider is not liable for any damages, including usage charges, the User may incur as a result of the unauthorized use of its telephone facilities.
  7. Without limiting any of the foregoing provisions of agreement, Additional Operating Policies and Conditions of Use for Users:

    • Use of the services provided in this agreement must be in accordance with local and national law. Services will be terminated or not provided if any law enforcement agency, acting within its jurisdiction, advises that such services are being used in violation of the law.
    • Users may not interfere with others use of Telephone Provider’s Service.
    • User may not use this Service for non-standard residential or non residential purposes, including but not limited to commercial or broadcast facsimile, resale, telemarketing, internet or other data connections and autodialing. The Telephone Provider may immediately suspend, restrict or cancel the User’s Service if used in this manner. Provider may also move User to a rated minute of use long distance plan and wherein the rates described in the Telephone Provider’s corresponding tariff will apply to such use.
    • Users may not use the Telephone Provider’s Services in any manner that disrupts the Telephone Provider system for other Users, or which threatens to or actually causes damage to the Telephone Provider’s system, or is considered to be abuse of the system. Depending upon the extent of the abuse, Users may receive warnings, or in some cases, have their Account suspended. Telephone Provider reserves the right to monitor User’s actions when deemed necessary to troubleshoot connectivity problems or determine if there is an abuse of the Telephone system.
    • Service is sold to a single User for use in a single household. Any attempt to resell or distribute service without the express written permission of Telephone Provider will result in immediate termination of service and possible criminal prosecution.
  8. Unless otherwise requested in writing, all residential phone numbers will be published in the ILEC Directory for the rate center served by the Telephone Provider. Customers who wish to not publish their number will be required to pay a monthly fee of $4.50 to remain unpublished and private.
  9. Violations of the User Conduct, Operating Policies and Conditions of Use are unethical and in some cases may be unlawful. Telephone Provider has no practical ability to restrict conduct which violates these policies and conditions and cannot ensure prompt removal of content or immediate cessation of violative conduct. Accordingly, Telephone Provider expressly denies a liability to Users or third parties for failure to enforce these policies and conditions.
  10. In its sole discretion, Telephone Provider may initiate an investigation and, in order to prevent further possible unauthorized activity, may suspend access to Service to the individual Account in question. Confirmation of violations may result in cancellation of the individual Account and/or criminal prosecution.

911 ACKNOWLEDGEMENTS

  1. User could lose E911 service under the following conditions:

    • The User relocates the CPE installed by Telephone Provider without first advising Telephone Provider of relocation. This will have an adverse affect on Telephone Providers ability to deliver 911 services.
    • Only numbers under the direct control of Telephone Provider and their partners are covered under this agreement. Any non-native numbers obtained by any means are not the responsibility of Telephone Provider or their partners. Use of non-native phone number on this CPE device could cause E911 services to not work.
    • Should the broadband connection fail the E911 service may not work properly.
    • In the event of an electrical power outage E911 services could be impacted after the battery life on the CPE has been exhausted and/or if CPE does in fact not have battery backup. Battery backup is not provided as a part of the Service.
    • If there is a delay in making the User’s registered location in the ALI database, E911 services will be impacted.
    • If your telephone service account or any other account with Telephone Provider is past due, Telephone Provider may terminate the telephone service upon notice to you. If Telephone Provider temporarily or permanently disconnects your telephone service because you failed to pay your bill, Telephone Provider will stop providing you with 911/E911 service.
    • E911 service may ring to the administrative line of the PSAP. Telephone Provider provides fully functioning E911 services and will always go to extraordinary lengths to maintain that service at the highest possible level. By signing this agreement User acknowledges that they understand that possible circumstances under which E911 services may not be available.
    • Litestream Holdings provides Basic 911 coverage nationwide and E911 where available. With E911 service, your registered address and phone number is automatically delivered to the proper local emergency call center. This information appears on the emergency dispatcher’s computer screen. If you live in an area where E911 has not yet been deployed, your call will be routed to an emergency call center through the traditional 911 network based on the information on record, however the dispatcher will not have your address and may not have your phone number.
    • For the purpose of providing 911 Dialing, Litestream Holdings must know the physical location of your Litestream Holdings telephone adapter. You will be prompted to provide this information during sign-up. If this address is not accurate or if you move your adapter to another location, even temporarily, you must use the Litestream Holdings online account management portal or call customer service at (877) 212-4744 between the hours of 8:00am and 8:30pm CST to update the physical location of your adapter. If the physical location of your adapter is not accurately on record, emergency services will not be able to locate you if you are unable to speak your address or are disconnected — even in areas where E911 service is available. Finally, 911 service will be disrupted by power outages or outages of your Internet service.
    • Upon sign up, it may take several hours to process your 911 address. In the interim, Litestream Holdings will send your 911 call to a National Emergency Response Center. Changes to your information will be reflected within minutes on average if there are no errors in the data provided.
    • You shall inform any household residents, guests and other third persons who may be present at the physical location where you utilize the service of the important differences in and limitations of dialing 911 from a Litestream Holdings phone. These limitations include but are not limited to unavailability in the event of a power outage.

INTERNET USE AGREEMENT

  1. Internet Provider agrees to provide and the User agrees to Internet service according to the price schedule separately attached and to the following terms and conditions:
  2. Internet Provider reserves the right to suspend or terminate User’s access to Internet service for any of the following reasons:

    • Upon receiving an indication of credit problems, including delinquent payments or rejection of any credit card charges, or
    • User’s failure to comply with all local, state and federal laws, rules and regulations governing User’s use of the Internet, or
    • Any unauthorized third party’s use of Internet services being provided to User with or without User’s consent, or
    • Any inappropriate or other misuse of the Internet so determined in the sole discretion and judgment of Internet Provider.
  3. Neither Internet Provider nor its information providers shall be responsible for any damages arising from User’s use of Internet service being provided by Internet Provider or by User’s inability to use Internet Provider’s Internet service, whether or not caused by the fault or negligence of Internet Residential Service Agreement Litestream Holdings (“Internet Provider”) and Momentum Telephone Company, LLC (“Telephone Provider”)

PRIVACY NOTICE

The Federal Cable Holdings Policy Act of 1984 contains certain provisions regarding the collection and disbursement of personally identifiable information by cable television operators. In accordance with those provisions, this cable system collects and maintains personally identifiable information concerning customers. That information includes, among other things, your name, address, phone number, billing records; service maintenance and repair records; premium service subscriptions information; marketing information and customer complaints.

Personally identifiable information is generally used for the normal business purpose of offering and rendering cable television service and other service to you. Some persons have access to such information when necessary in connection with our business or when otherwise desirable. Access may be on a day-to-day basis. Those people who have access include cable system employees; cable system sales agents; businesses which provide service to the cable system, such as our accountants, billing and collection services, program and program guide providers where applicable; program services which will periodically audit subscriptions information and other business that seeks to use your name, address, etc. The cable system will not maintain such information after it is no longer necessary for carrying on our business. As a customer, you may review any personal information held by us which pertains to you if you give us a reasonable period of time to locate and, if necessary, prepare the information for review. Preparation is sometimes necessary to avoid disclosure of information relating to other customers. If you wish to review your personal information, please contact us by letter or telephone to arrange a review. The review will be at our local system business office. You may request correction of any errors in personal information which we collect and maintain pertaining to you. Federal law prohibits collection of any personally identifiable information other than information necessary to carry on our business or to detect theft of service, unless you consent.

To the extent that we are permitted to collect personally identifiable information, we are permitted to disclose such information only to the extent necessary to conduct our business. In addition, the law allows us to disclose your name and address for non-cable service related mailing lists or other purposes unless you tell us you do not wish us to disclose it. However, such disclosures of names and addresses may not be in a form that discloses the extent or type of any use you make of service we provide, nor may it disclose the nature of any transaction you make over the cable system. If you do not wish to have your name and address disclosed even in limited situation described above, or if you wish to limit the circumstances in which we will disclose it, please obtain, fill out and return an address form from our local business office. Except as indicated in the previous paragraph, we may not disclose personally identifiable information without your consent, unless we are required to do so by court order. If we are served with a court order requiring disclosure of personally identifiable information concerning a customer, we will inform the customer before any information is released. Under some circumstances, a governmental entity may seek a court order to obtain personally identifiable information from the cable system concerning a cable customer. The customer must be given an opportunity to consent to issuance of such an order. Any person aggrieved by an act of a cable operator in violation of these federal limitations on the collection and disclosure of personally identifiable information may bring a civil action in a United States District Court to enforce the limitations.

Litestream Customer Bill of Rights -

Litestream Holdings subscribers have access to an ever changing network, providing state-of-the-art video, internet and telephone services. We offer a variety of broadband services, including digital cable, high speed internet, and digital telephone to both residential and commercial customers.

You are important to us. It is also important to us that you are informed about your rights as a Litestream customer, our policies and procedures, and all of the services we provide.

Under the Cable Holdings Policy Act of 1984 ("Cable Act"), you are entitled to know the limits imposed on cable operators, your privacy options - especially regarding personal information, how it is collected, how it is used, and how it is maintained.

Customer Service

Litestream Holdings has local offices in many of our communities as part of our franchise agreements. With offices conveniently located in major service areas, we also have payment options for all communities. Please see the complete list of office locations, payment options and payment centers for locations, hours of operation, and phone numbers.

Payment Procedures

Litestream Holdings has a monthly cycle billing. Billing begins upon installation and is prorated to the first of the month immediately after your date of installation. (Example: Your installation is completed on the 13th of the month. Your billing will be prorated to the first of the next month and your regular billing cycle will be the 1st, and you are billed for services from the 1st to the last day of the month.) You can expect to receive your bill 3 to 4 days after your cycle, and it will be due 15 days after your cycle. Your bill is itemized so you know what you are being charged for each level of service, equipment, pay-per-view, installation fees (if applicable), taxes, and franchise fees. We also list any adjustments to your bill, such as credits or over use charges. Payments may be made by cash, check, money order, credit card or debit card. You may pay your bill by mail, in an office or at a payment center, by telephone, by establishing an auto debit electronic funds transfer directly from your checking account, or on line at www.litestream.net. Service fees may apply.

A late payment fee will be added to your bill if we do not receive payment by the due date on your statement. Late fees vary by state. For accounts in arrears, you will be notified with a final notice statement, telephone reminder, or a visit from one of our friendly technicians who will accept your payment at the door in lieu of disconnecting service. Litestream charges a $25.00 trip charge should we make the collection in the field. If no payment is received by the time a technician arrives, your service will be terminated and you will be responsible for all charges on the account, including late fees. We will be more than happy to reconnect your services when the account is brought up to date, and you will be charged a nominal reconnect fee.

Billing Dispute Procedures

If you have any questions regarding your bill, you may contact your nearest Litestream office, or call our corporate call center at (877) 212-4744.

In most cases, a customer service representative will be able to resolve your complaint about your bill. If you feel your complaint is not being handled to your satisfaction, please ask to speak to a customer service manager or supervisor. If you are dissatisfied with the assistance he or she offers, you may direct your dispute to Litestream Management.

Disputes may also be settled by writing to Litestream. We will respond within 30 days to all written complaints. Please, pay your bill first, including any disputed amount, to avoid being disconnected. Upon resolution of your complaint, if a credit is issued, it will be reflected on your account. Please address all billing complaints to your local office as listed on the Contact Us page.

Litestream Holdings' goal is to provide our customers with the best products and service possible. If for any reason you are not happy with our products or personnel, please follow these guidelines:

  1. Call Litestream and ask to speak to the manager or supervisor connected to your complaint.
  2. If you are not happy with the help he or she offers, ask to speak to Management. Letters regarding individual or community issues are welcomed.
  3. If you still feel your complaint is not being addressed by Litestream, contact your local franchise authority (city, town, county).
  4. If/when your complaint is satisfactorily resolved, we want to know that too! Please share your successes with us so that we may close out the complaint, or have your account noted for future reference.

Home Wiring Information

Home wiring is the cable which runs from your television set, computer, or telephone to approximately twelve inches outside your dwelling. This is known as the point of demarcation, or "demark". Home wiring includes all the wiring inside your home, including extra outlets, as well as splitters, connections, in-home amplifiers, fittings or wall plates attached to wire. It does not include equipment that is provided to you by Litestream, any aftermarket wiring for multimedia interfaces, computers, surge protectors, answering machines, power cords, etc. not provided by Litestream.

Litestream installs high-quality coaxial cable and other wiring materials for the strongest and clearest signals possible. Quality wiring is critical to the integrity of the quality of your services. Upon request, we will rearrange, remove, add, replace or maintain cable home wiring for a minimal charge, based on published service rates. All customers also have the option of selecting a third-party contractor, or perform services themselves, as long as those actions do not interfere with Litestream's ability to meet the FCC's technical standards or to provide service to other customers. Customers who elect to rearrange, replace, add or maintain their own wiring may obtain materials from us at slightly above our cost.

You will be responsible for rectifying issues that result from home wiring that is not installed by Litestream and results in harmful or improper signal leakage, or the need for a technician to visit your home for service. Litestream is required by the FCC to terminate any service to a location where signal leakage problems are not corrected.

Television Picture Quality Resolution Notification

Litestream will do everything possible to make sure that the picture you receive is the best that it can possibly be. Before you call for technical assistance, please try answering these quick questions:

  1. Does the problem is affect all the television sets in your home connected to the Litestream cable television service, or just one?
  2. If you have a receiver, is your television tuned to channel 3?
  3. Are all of your cable-ready television sets set to ‘CATV' (or cable tv option)?
  4. Are all of the connectors from the wall to the tv set or other pieces of equipment tight? (Snap-on connectors provide very poor signal. Make sure you have the type that screw-on to tighten.)
  5. Are the batteries in your remote control working?

If you have tried to resolve your issues by answering the questions above, and you haven't been able to fix the problem, call your local customer service department to schedule a service call.

Service and Repair Guidelines

New technical standards for the cable industry were established in the 1992 Cable Act and interpreted in pertinent FCC documentation. Contained in these standards are regulations that require us as a cable company to establish a process for resolving complaints about the quality of your TV signal and notify you of this procedure each year. If you feel there is a problem with your picture, we want you to contact us immediately. Here is how you can help us solve the problem quickly:

  1. If you are having a problem with your picture during regular business hours, call your local Litestream office and a customer service representative will work with you to analyze and solve your problem. If this does not work, a service call will be entered for your home and a technician dispatched within 24 hours under normal circumstances.
  2. If you call about a service issue outside of regular business hours, the call may be answered by our answering service. They will forward your request to an on-call technician. Please leave both your home and work phone numbers. Whenever possible, the technician will be dispatched as right away. In all other cases, the service will forward the information to our office, and you will be called the next business day to resolve the problem.
  3. Outages are emergencies that affect signal quality. This could be from a fallen utility pole, violent storm, or ice storm or other weather event that would interfere with reception. We are committed to having crews promptly correct an emergency situation. We will immediately respond if a large area is experiencing technical difficulties. Please keep in mind the safety of our employees is also very important to us, so if the severe weather is a threat to the employees, they will begin emergency response as soon as it is safe to do so.
  4. Our dispatchers and technicians are trained and have the authority to do whatever is reasonable to solve the problem or initiate the solution in order to provide quality service.
  5. We will keep records of signal quality complaints for a minimum of one year for inspection by the FCC or our local franchising authority.
  6. If you still feel your problem has not been corrected, please call our Director of Technical Operations at (877) 212-4744 to express your concerns and seek further resolution. If you still feel that your issue is not being resolved, you may contact the local franchise authority.

Scheduling Installations or Repairs

Installation of a converter box or any other equipment inside the home requires that you are present at the time of installation. Installations are conducted Monday through Friday between 8 am and 5 pm. For your convenience we offer morning appointments and afternoon appointments. Service technicians are on call 24 hours a day. A technician will not complete service call inside the home if there is no adult over the age of 18 present.

Television Equipment Compatibility

Some models of televisions and VCR's (especially older models) may not be cable ready. This means that they cannot receive all of the channels offered by the cable system when connected directly to the cable system. In this case, you may need a set-top channel converter box. You can obtain a set-top converter box from Litestream or a retail store for a nominal charge. This will enable your TV and/or VCR to receive all of the cable channels that you subscribe to.

Some services, including digital cable, premium channels and pay-per-view, provided by Litestream may be scrambled or encrypted. If you wish to subscribe to any of these services you will need a converter box or navigation device, like a cable card, that is compatible with our security access procedures. These may be leased from Litestream or purchased from a retail outlet. If you purchase this equipment from a retail outlet, we can provide you with the necessary technical parameters to be able to operate with our cable system.

Note: Receivers with descrambling units are illegal to sell or use unless they are authorized by Litestream Holdings.

Theft of Cable Service

It is important for you as a customer to know that we work to protect our services, and yours, from unauthorized reception. The Cable Policy of 1984 "prohibits the unauthorized reception of Holdings services over a cable system or converter to receive services which are not authorized." It is a violation of law to alter the cable system or converter to receive services which are not authorized. Litestream conducts routine audits of our system to insure compliance with the law and to protect our paying customers. We reserve the right to inspect for signs of tampering. Where violations are found, Litestream will prosecute to the fullest extent of the law, including civil as well as criminal action. Unauthorized reception of cable television signals is punishable with fines and/or imprisonment.

The customer must be given an opportunity to consent to issuance of such an order. Any person aggrieved by an act of a cable operator in violation of these federal limitations on the collection and disclosure of personally identifiable information may bring a civil action in a Untied States District Court to enforce the limitations.

Litestream Holdings offers products and services in three broadband categories:

  • Cable Television Service
  • High Speed Internet Service
  • Digital Telephone Service

Not all services are available in all areas, and services vary by area.

Internet Acceptable Use Policy

Litestream Holdings provides a variety of Internet Services (the Services) to residences and businesses (the Customer).

Litestream Holdings may modify this Acceptable Use Policy from time to time. For this reason, Litestream Holdings users should consult the Litestream Holdings website (www.Litestream.tv or "My Account") regularly to ensure that their actions are in compliance with the most recent version of the Acceptable Use Policy. In the event of any conflict between this Acceptable Use Policy and the Litestream Holdings Terms and Conditions of Use, this Acceptable Use Policy will govern. You agree that if any portion of this Policy is held invalid or unenforceable, that portion will be construed consistent with applicable law as nearly as possible, and the remaining portions will remain in full force and effect.

1.0 Introduction

1.1 This Acceptable Use Policy is designed to foster an online environment of mutual respect in which everyone is able to enjoy the benefits of Litestream Holdings. We believe that the restrictions set out in this Acceptable Use Policy represents a fair balance between the freedom of the individual and the need for some basic rules to ensure that Litestream Holdings’ Internet access is not used in an abusive or illegal way.

1.2 Litestream Holdings users are responsible for ensuring that their accounts are used in accordance with this Acceptable Use Policy. If Litestream Holdings has reason to suspect that a user, or anyone using a user’s account, is violating this Policy, then the account in question may be suspended pending an investigation. If, after an investigation, Litestream Holdings determines that an account has been used in violation of this Policy, Litestream Holdings may, in its discretion, terminate the user account. If you do not agree to abide by this Acceptable Use Policy your service is subject to disconnection. You may contact Litestream Holdings Customer Service with questions during our normal business hours.

1.3 Litestream Holdings may or may not actively monitor its user’s use of its services. We rely on our users to govern themselves and to protect the integrity of the network by reporting any violations of this Acceptable Use Policy.

1.4 Litestream Holdings has the right, but not the obligation, to investigate any violation or alleged violation of this Acceptable Use Policy, including the right to examine any information or material on Litestream Holdings’ servers.

1.5 Litestream Holdings has the right, but not the obligation, to remove any content that it deems, in its sole discretion, to be in violation of any part of this Acceptable Use Policy.

1.6 Litestream Holdings has the right, but not the obligation, to take any steps it deems necessary to prevent violations of this Acceptable Use Policy from occurring.

1.7 The failure of Litestream Holdings to enforce this Policy, for whatever reason, shall not be construed as a waiver of any right to do so at any time.

2.0 Illegal Activities

Litestream Holdings users must not use Litestream Holdings to encourage, facilitate or engage in any illegal activities, including, without limitation: defamation: posting or transmitting any material which is defamatory under any applicable law; fraud: posting or transmitting any information that you know or ought to know is false, and that you intend others to rely on; unlawful material: posting or disseminating unlawful material false advertising: posting or transmitting any advertising or promotional materials that contain false, deceptive or misleading statements, claims or representations; copyright violation: posting or transmitting any information, software, photograph, video, graphic, music, sound and other material in violation of another person’s copyright; and trade-mark violation: posting, transmitting, displaying or using any words or symbols that violate any other person’s rights in its trade-mark or trade-name.

3.0 Electronic Mail

3.1 Litestream Holdings users must not use Litestream Holdings e-mail to: send unsolicited bulk e-mail (so-called “Spam”); send, or cause to be sent, large volumes of unsolicited e-mail to a single or multiple people or entities (so-called “E-Mail Bombing”); repeatedly send e-mail to any person or entity who does not wish to receive it. If a recipient asks to stop receiving e-mail from a Litestream Holdings user, then that Litestream Holdings user must not send that person further e-mail and subscribe to any e-mail list or service on behalf of a third party without that third party’s consent.

3.2 Litestream Holdings users must not engage in any of the activities described in paragraph 3.1 from another provider’s e-mail service and use a Litestream Holdings account as an e-mail return address or “drop” for responses.

3.3 Litestream Holdings users must not forge, alter or remove any e-mail header. Any e-mail address at the Litestream.tv domain is property of Litestream Holdings and may be terminated or reassigned without notice.

4.0 Security, Privacy and “Hacking”

The Customer is responsible for any misuse of the Services that originate from their account, even activities committed by any friend, family, co-worker, employee, guest or anyone with access to the account. Customers must ensure that others not gain unauthorized access to the Services.

4.1 Litestream Holdings users must not: disrupt or interfere with the normal operation of Litestream Holdings systems, networks, or activities in any way that adversely affects the ability of other people, or systems to use Litestream Holdings services or the Internet, including, but not limited to: denial of service attacks; flooding of networks; attempts to overload a service; and attempts to cause system crashes, or attempt to do so; or use any unauthorized program to connect the user to any Litestream Holdings Internet Relay Chat (“IRC”) server, including, but not limited to, IRC bots or clone bots; gain access or attempt to gain access to the private systems or data of Litestream Holdings, without the prior consent of Litestream Holdings.

4.2 Litestream Holdings users must not use their Litestream Holdings accounts to: circumvent or attempt to circumvent security or authentication systems on any host, network hardware, or user accounts, including, but not limited to, logging into any server, account or network without authorization and electronically probing the security of any system or network; or disrupt or interfere with the normal operation of any system or network operated by any third party, or attempt to do so. gain access or attempt to gain access to the private systems or data of Litestream Holdings, or any third party without the prior consent of Litestream Holdings or the third party.

5.0 Usenet Newsgroups

5.1 Litestream Holdings users must not: post a single article or substantially similar articles to an excessive number of newsgroups, or cross-post to an excessive number of newsgroups; post articles on a newsgroup which are off-topic according to the newsgroup charter; post binary or encoded binary files to newsgroups not specifically designated for that purpose; post commercial messages on a non-commercial Litestream Holdings newsgroup without prior approval from Litestream Holdings; engage in any of the above from a provider other than Litestream Holdings and use an account on Litestream Holdings as an e-mail return address or “drop” for responses, or engage in any of the above from a provider other than Litestream Holdings for the purpose of drawing attention to a service hosted by or on Litestream Holdings’ network. Litestream Holdings reserves the right to discontinue access to any Usenet newsgroup at any time and for any reason.

6.0 Censorship and Adult Materials

Litestream Holdings believes in freedom of expression and the right of individuals to decide for themselves what they want to see and listen to. We do not believe it is the place of an ISP to censor or regulate the Internet. However, users must not use Litestream Holdings to transmit or post any information or image that is criminally obscene or otherwise prohibited under any applicable law. Litestream Holdings assumes NO responsibility for Internet content available through the Services. Customers are responsible for restricting access to sexually explicit material on the Internet, by purchasing the appropriate filtering software, or by monitoring Internet use. Content questions or complaints should be addressed to the content provider.

7.0 Miscellaneous

7.1 False Pretenses. Users must not use Litestream Holdings to impersonate any person or use a fictitious user name with any of Litestream Holdings’ services, including in any e-mail, Usenet posting, or Internet Relay Chat (“IRC”) site. This restriction does not preclude the use of nicknames in IRC, the use of anonymous re-mailer services, or postings to any site that permits pseudonyms.

7.2 Unsolicited Advertising. Users must not use Litestream Holdings to post or transmit any unsolicited advertising, promotional materials or other forms of solicitation to any person except in those areas and on those websites that are designated for such a purpose.

7.3 Harassment, Threats and Abuse. Users must not use Litestream Holdings to harass, threaten, or abuse any person or group of people by any means.

7.4 Crude or Offensive Postings. Users must not use Litestream Holdings to post offensive or crude messages or images on publicly accessible pages or sites, except where such messages or images are appropriate having regard to the nature of the site. Litestream Holdings has the right, but not the obligation, to remove messages or images that Litestream Holdings, in its sole discretion, determines are offensive.

7.5 Multiple access. Users must not maintain more than one simultaneous connection to Litestream Holdings or any Litestream Holdings service, IRC Chat group, or newsgroup.

7.6 Disruptive Conduct. Users must not use Litestream Holdings to disrupt the normal flow of online dialogue, or otherwise act in a manner that negatively affects other users, individuals or entities.

7.7 Servers. Users are not prohibited for operating servers but should understand that servers use more than normal amounts of bandwidth. Users should be monitoring traffic usage and must upgrade to a package suitable for such use or will be charged for the network traffic bandwidth used as follows:

8.0 Bandwidth/Network Traffic and Other Limitations

8.1 LITESTREAM HOLDINGS ACCEPTABLE USE POLICY

To protect our customers and maintain quality levels of service Litestream Holdings LLC has created a policy to address those few customers that misuse their internet access and negatively affect other customers on the network. Litestream Internet Service shares a common network with both residential and commercial subscribers. In certain cases, most often with high bandwidth usage commercial accounts, Litestream may also sell dedicated direct fiber data circuits which confines bandwidth usage only to the dedicated customer account at an additional cost to the customer. This provides maximum bandwidth availability without impacting other users on the common network. To protect the customer experience for the majority of our users, Litestream Holdings LLC has implemented a policy to suspend or terminate Service accounts where data consumption is not characteristic of a typical user of the Service as determined by the company in its sole discretion. Litestream Holdings LLC has established a monthly data consumption threshold that we will monitor on a regular or real time basis. Those customers that are in excess of our reasonable consumption threshold and considered by the company to be negatively impacting the internet experience of other customers will be considered in violation of this Policy. Common activities that may cause excessive data consumption in violation of this Policy include, but are not limited to, numerous or continuous bulk transfers of files and other high capacity traffic using (i) file transfer protocol ("FTP"), (ii) peer-to-peer applications, and (iii) newsgroups. You must also ensure that your use of the Service does not restrict, inhibit, interfere with, or degrade any other person's use of the Service, nor represent (as determined by Litestream Holdings LLC at its sole discretion) an overly large burden on the network. In addition, users must ensure that their activity does not improperly restrict, disrupt, inhibit, degrade or impede Litestream Holdings’ ability to deliver the Services and monitor the Services, backbone, network nodes, and/or other network services. Litestream has the right to restrict users that exceed their network traffic. Customers may not resell, share, or otherwise distribute the Services or any portion thereof to any third party without the written consent of Litestream Holdings. For example, you cannot provide Internet access to others outside of your household or your business through a wireless or dial-up connection, host shell accounts over the Internet, provide email or news service, or send a news feed unless express permission is granted by the customer agreement. You may not provide network services to others via Litestream Holdings.

Our goal is to provide each internet customer with a fast and reliable service. To meet this goal we will monitor those individuals that negatively affect the majority of our customer’s internet experiences. In each case, Litestream Holdings LLC may, in its sole discretion, suspend or terminate a Service account or request that you subscribe to a version of the Service (such as a commercial grade Internet service, if appropriate) if you wish to continue to use the Service at higher data consumption levels. Litestream Holdings LLC may also provide versions of the Service with different speed and data consumption limitations, among other characteristics, subject to applicable Service plans. Litestream Holdings LLC's determination of the data consumption for Service accounts is final.

10.1 Please direct any questions you may have regarding this Acceptable Use policy and complaints regarding violations of this Policy by other Litestream Holdings users to your local Litestream Office.

CPNI Policy

Litestream is committed to maintaining the privacy of its customers. In addition to protecting your personal information as outlined in Litestream’s Privacy Policy, we are obliged to give additional protections to certain information about how you use your services. However, that information can help us customize and improve services we offer you.

In this section, we describe what information we protect and how we protect it.

CPNI PROTECTIONS

As a customer of our services, you have the right, and Litestream has a duty, under federal law, to protect the confidentiality of certain types of services, including: (1) information about the quantity, technical configuration, type, destination, location, and amount of your use of your services, and (2) information contained on your telephone bill concerning your services you receive. That information, when matched to your name, address, and telephone number is known as “Customer Proprietary Network Information,” or “CPNI” for short. Examples of CPNI include information typically available from telephone-related details on your monthly bill, technical information, type of service, current telephone charges, long distance and local service billing records, directory assistance charges, usage data and calling patterns.

CPNI does not include things like customer name, address, or telephone number; aggregate information or data that is not specific to a single customer; customer premises equipment; and Internet access services.

Unless Litestream obtains your approval, Litestream may not use this CPNI to market products and services to you other than for services you currently purchase.

Customer proprietary network information (CPNI) is information related to the quantity, technical configuration, type, destination, location, and the amount of telecommunications a customer uses that Litestream has access to by virtue of the customer-provider relationship. CPNI does not include the Customer name, address and telephone number, nor does it include Internet access services.

APPROVAL

From time to time, Litestream would like to use the CPNI information it has on file to provide you with information about Litestream’s communications-related products and services or special promotions. Litestream’s use of CPNI may also enhance its ability to offer products and services tailored to your specific needs. Accordingly, Litestream would like your approval so that Litestream may use this CPNI to let you know about communications-related services other than those to which Customer currently subscribes that Litestream believes may be of interest to Customer. IF YOU APPROVE, YOU DO NOT HAVE TO TAKE ANY ACTION.

However, you do have the right to restrict our use of your CPNI. YOU MAY DENY OR WITHDRAW LITESTREAM’S RIGHT TO USE YOUR CPNI AT ANY TIME BY: Phone: (877) 212-4744 or by Email:CustomerService@litestream.net

If you deny or restrict your approval for Litestream to use your CPNI, you will suffer no effect, now or in the future, on how Litestream provides any services to which you subscribe. Any denial or restriction of your approval remains valid until your services are discontinued or you affirmatively revoke or limit such approval or denial.

In some instances, Litestream will want to share your CPNI with its independent contractors and joint venture partners in order to provide you with information about Litestream’s communications-related products and services or special promotions. Prior to sharing your CPNI with its independent contractors or joint venture partners, Litestream will obtain written permission from you to do so.

CUSTOMER AUTHENTICATION

Federal privacy rules require Litestream to authenticate the identity of its customer prior to disclosing CPNI. Customers calling Litestream’s customer service center can discuss their services and billings with a Litestream representative once that representative has verified the caller’s identity. There are three methods by which Litestream will conduct customer authentication:

  1. by having the Customer provide a pre-established password and/or PIN;
  2. by calling the Customer back at the telephone number associated with the services purchased; or
  3. by mailing the requested documents to the Customer’s address of record.

Passwords and/or PINs may not be any portion of the Customer’s social security number, mother’s maiden name, amount or telephone number associated with the Customer’s account or any pet name. In the event the Customer fails to remember their password and/or PIN, Litestream will ask the Customer a series of questions known only to the Customer and Litestream in order to authenticate the Customer. In such an instance, the Customer will then establish a new password/PIN associated with their account.

NOTIFICATIONS OF CERTAIN ACCOUNT CHANGES

Litestream may disclose CPNI in the following circumstances:

  • When the Customer has approved use of their CPNI for Litestream or Litestream and its joint venture partners and independent contractors (as the case may be) sales or marketing purposes
  • When disclosure is required by law or court order.
  • To protect the rights and property of Litestream or to protect Customers and other carriers from fraudulent, abusive, or unlawful use of services.
  • When a carrier requests to know whether a Customer has a preferred interexchange carrier (PIC) freeze on their account.
  • For directory listing services.
  • To provide the services to the Customer, including assisting the Customer with troubles associated with their services.
  • To bill the Customer for services.

PROTECTING CPNI

Litestream uses numerous methods to protect your CPNI. This includes software enhancements that identify whether a Customer has approved use of its CPNI. Further, all Litestream employees are trained on the how CPNI is to be protected and when it may or may not be disclosed. All marketing campaigns are reviewed by a Litestream supervisory employee to ensure that all such campaigns comply with applicable CPNI rules.

Litestream maintains records of its own and its joint venture partners and/or independent contractors (if applicable) sales and marketing campaigns that utilize Customer CPNI. Included in this, is a description of the specific CPNI that was used in such sales or marketing campaigns. Litestream also keeps records of all instances in which CPNI is disclosed to third parties or where third parties were allowed access to Customer CPNI.

Litestream will not release CPNI during customer-initiated telephone contact without first authenticating the Customer’s identity in the manner set-forth herein. Violation of this CPNI policy by any Litestream employee will result in disciplinary action against that employee as set-forth in Litestream’s Employee Manual.

BREACH OF CPNI PRIVACY

In the event Litestream experiences a privacy breach and CPNI is disclosed to unauthorized persons, federal rules require Litestream to report such breaches to law enforcement. Specifically, Litestream will notify law enforcement no later than seven (7) business days after a reasonable determination that such breach has occurred by sending electronic notification through a central reporting facility to the United States Secret Service and the FBI. Litestream cannot inform its Customers of the CPNI breach until at least seven (7) days after notification has been sent to law enforcement, unless the law enforcement agent tells the carrier to postpone disclosure pending investigation. Additionally, Litestream is required to maintain records of any discovered breaches, the date that Litestream discovered the breach, the date carriers notified law enforcement and copies of the notifications to law enforcement, a detailed description of the CPNI breach, including the circumstances of the breach, and law enforcement’s response (if any) to the reported breach. Litestream will retain these records for a period of not less than two (2) years.

NOTIFICATION OF CHANGES TO THIS POLICY

If we change this CPNI Policy, we will post those changes on https:// www.litestream.net/service-policies/ or in other places we deem appropriate, so that you can be aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. If you decide to continue receiving your services after we make any changes to this the CPNI Policy, you shall be deemed to have given express consent to the changes in the revised policy.
